Terms of Service

The contractual terms that govern every KAVOD engagement — payment policies, delivery timelines, ownership, and everything in between. Plain language, no hidden clauses.

Last updated: August 2026 · Effective for all new and ongoing projects

01

Engagement & Scope

These Terms of Service govern the relationship between KAVOD ("we", "us", "the Agency") and any client ("you", "the Client") engaging our web development, design, or maintenance services. By submitting a project enquiry, booking a consultation, or paying any invoice, you agree to these terms. A formal scope of work is agreed in writing (email or WhatsApp counts) before any build begins. Any work outside that agreed scope is billed separately at our standard hourly rate.

02

Payment Terms

All prices are quoted in United States Dollars (USD). We accept payment via EcoCash, Paynow, bank transfer, or cash. For projects, a 50% deposit is required before work begins; the remaining 50% is due before the final site is handed over. For monthly Care Plans, payment is due in advance on the 1st of each billing cycle. Invoices not settled within 7 days of the due date may result in work being paused or the site being taken offline. Late payments do not entitle you to a refund of work already completed.

03

Project Delivery & Timelines

Starter sites are typically delivered within 3–5 business days; Business and Custom projects within 2–4 weeks, depending on scope and how promptly you provide content and feedback. Timelines are estimates, not guarantees — they assume you respond to review requests within 48 hours. If you do not provide content, assets, or approvals within 14 days of request, the project may be placed on hold. Reactivation requires a new deposit if more than 60 days have passed.

04

Revisions & Change Requests

Each tier includes a set number of revision rounds during the build phase: Starter includes 2 rounds, Business includes 4 rounds, and Custom projects include unlimited rounds until launch. A revision is a change to existing pages or content — not the addition of new pages or features. Changes requested after final approval and handover are billed at our standard hourly rate. We will always tell you before incurring additional charges.

05

Ownership & Intellectual Property

Upon receipt of full payment, you own the finished website, its content, and all associated design files. We transfer domain ownership to you at no cost. We retain the right to display your project in our portfolio and marketing materials unless you request otherwise in writing. Third party assets (fonts, plugins, stock imagery) are licensed under their respective terms and are your responsibility to maintain after handover.

06

Hosting & Maintenance

Hosting is included free for the first 12 months on all tiers. After that, hosting continues at no cost as long as you maintain an active Care Plan subscription. If you cancel your Care Plan, you may arrange your own hosting — we will provide a full site export and assist with migration at no charge within 30 days of cancellation. We are not responsible for downtime, data loss, or security breaches on third party hosting we do not manage.

07

Cancellation & Refunds

You may cancel a project at any time. The initial 50% deposit is non refundable once work has begun, as it covers discovery, design, and project setup. If you cancel before work begins, the deposit is refundable minus a 10% administrative fee. Monthly Care Plan subscriptions can be cancelled at any time and remain active until the end of the current billing cycle. No refunds are issued for partial billing periods.

08

Limitation of Liability

KAVOD provides services on an "as is" basis. We are not liable for indirect, incidental, or consequential damages, including loss of revenue, profits, or data, arising from the use or inability to use your website. Our total liability for any claim is limited to the total amount you paid us for the specific project giving rise to the claim. We are not responsible for issues caused by third party services (payment gateways, hosting providers, domain registrars) or by your own modifications to the site after handover.

09

Governing Law

These terms are governed by the laws of the Republic of Zimbabwe. Any dispute arising from these terms or our services shall be resolved amicably through good faith negotiation first. If resolution cannot be reached, the matter shall be referred to mediation in Harare. These terms may be updated from time to time; the version current at the date of your project commencement applies to your engagement.
